Another mood theme question

[personal profile] boji's recent post reminded me of something I'd been wondering for a while: if I wanted to copy the images that make up the mood theme I use on LJ and use them to create the same mood theme on Dreamwidth, are there any rights issues there, or are LJ mood themes considered public property once created? I am not the person who created the theme on LJ.

LJ themes which were free to use have been already imported, I believe. If the theme wasn't even created by LJ then you have to ask this person how they want to share their theme (providing they have any right on the images and didn't use someone else's art in the first place).

Does this also apply if the mood theme isn't offered up for public use?

The one I was trying to import is made up of film stills ripped from a classic film.

Well they did offer it up for share/comment & credit. I wouldn't have found it otherwise *g*. Mind you that was over on LJ, so maybe using it on a different blog service is an issue.

I left a comment stating my intent, so we'll see.
